Bill of Rights
Article 8
|
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. |
This is pretty self explanatory.
Infringing upon the Liberty of a person by imposing an excessive bail is a crime under the Common Law.
The same can be said of cruel and unusual punishments as they would cause undue humiliation and embarassment.
